1. AGREEMENT TO TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Customer”) and FiGGZO LLC (“FiGGZO,” “Company,” “we,” “us,” or “our”), governing your access to and use of www.FiGGZO.com and all related services, content, features, tools, products, and functionality (collectively, the “Services”).

7. SHIPPING & RISK OF LOSS

Estimated U.S. Delivery: 3–7 business days
Estimated International Delivery: 7–21 business days

Delivery timeframes are estimates only and not guaranteed.

Once an order is transferred to the shipping carrier:

  • Title and risk of loss pass to you
  • We are not responsible for carrier delays
  • We are not liable for packages marked “delivered”

International customers are solely responsible for customs duties, import taxes, and brokerage fees.

 

8. RETURNS & REFUNDS

Returns are subject to our Return & Refund Policy.

Key conditions include:

  • 14-day return window from delivery date
  • Items must be unused, unworn, and in original packaging
  • Sale, Clearance, and Final Sale items are non-refundable

Refunds are issued to the original payment method.

We reserve the right to deny returns that do not comply with our policy.

Is the exclusive property of FiGGZO LLC and are protected by United States and international intellectual property laws?

If fraudulent or suspicious activity is detected, we may:

  • Cancel orders
  • Suspend or permanently ban accounts
  • Submit evidence to payment processors and law enforcement

Improper or fraudulent chargebacks may result in:

  • Permanent account termination
  • Collection’s proceedings
  • Legal action for damages and fees

You agree to contact customer support before initiating a chargeback.

 

12. THIRD-PARTY SERVICES

Our website is powered by Shopify, Inc. However:

  • All transactions are between you and FiGGZO LLC
  • Shopify is not responsible for products sold
  • You release Shopify from liability arising from transactions

We may provide access to third-party tools or links. We are not responsible for third-party content, policies, or services.

Use of third-party services is at your own risk.

 

13. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT

We do not guarantee uninterrupted, secure, or error-free operation.

 

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

FiGGZO LLC shall not be liable for:

  • Lost profits or revenue
  • Data loss
  • Business interruption

Our total aggregate liability shall not exceed the amount paid by you for the product giving rise to the claim.

 

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless FiGGZO LLC, its officers, directors, employees, affiliates, and service providers from and against any claims, damages, liabilities, costs, and expenses arising from:

  • Your breach of these Terms
  • Your misuse of the Services
  • Your violation of applicable laws or third-party rights

 

16. BINDING ARBITRATION & CLASS ACTION WAIVER

Any dispute arising from these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA).

Arbitration shall take place in Missouri, United States.

You waive:

  • The right to a jury trial
  • The right to participate in class or collective actions

This provision does not apply to intellectual property enforcement.

 

17. GOVERNING LAW

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

For matters not subject to arbitration, you consent to exclusive jurisdiction in Missouri courts.

 

18. TERMINATION

We reserve the right to suspend or terminate access to the Services at any time, for any reason, without notice.

Provisions relating to intellectual property, arbitration, limitation of liability, and indemnification shall survive termination.

 

19. MODIFICATIONS TO TERMS

We may update or modify these Terms at any time at our sole discretion.

Changes become effective upon posting.

Continued use of the Services constitutes acceptance of the revised Terms.
